New York Medical Malpractice Statute of Limitations

In New York, a medical malpractice claim must be brought within the statute of limitations or else the patient will lose the claim for good. Generally, the statute of limitations in New York is two and a half years from the date of the action or inaction that led to the injury. However, if the patient is injured but receives continuous treatment, the statute of limitations begins at the conclusion of the treatment.
