The way to become the trustee of the presumed trust that will be set up for your nephew who is a minor is to ask to be appointed such subject to court confirmation of distribution of assets from the resulting trust from your brother's estate subject to court confirmation. I highly recommend that you consult with a Wills and trust attorney to assist you in the endeavor. One can be found on attorneypages.com in your community.
